Racee is committed to protecting your privacy and complying with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Data Controller:
Racee is the data controller for the personal information we collect through the Platform.
We collect the following types of personal information:
When you create an account:
– Full name
– Email address
– Password (encrypted)
When you list a ticket for sale (Sellers):
– Race entry details
– Original ticket purchase price
When you purchase a ticket (Buyers):
– Billing address
– Payment card details (processed securely by our payment provider, Ryft – we do not store full card details)
– Name of runner and email for ticket transfer purposes
– Date of birth of runner (required by some race organisers for ticket transfers)
– Postal address (required by some race organisers for ticket transfers or bib delivery)
– The specific information required depends on the race organiser’s transfer system
When you contact us:
– Correspondence details
– Any information you choose to provide in support requests or disputes
When you use the Platform:
– IP address
– Browser type and version
– Device information
– Operating system
– Pages visited and time spent on pages
– Referring website
– Cookies and similar tracking technologies (see Section 8)
Payment information:
- We receive transaction confirmation and payment status from Stripe
Race organiser information:
– We may receive ticket transfer confirmations from race organisers to verify successful transfers
We use your personal information for the following purposes:
– Create and manage your account
– Process ticket listings and purchases
– Facilitate ticket transfers between Sellers and Buyers
– Process payments and refunds
– Communicate transaction details and updates
– Provide customer support
– Verify user identity
– Prevent fraud and abuse
– Comply with tax and accounting requirements
– Respond to legal requests and court orders
– Enforce our Terms and Conditions
– Improve and develop our Platform
– Analyse usage patterns and trends
– Send service-related notifications
– Maintain security and prevent unauthorised access
– Resolve disputes between users

– Send marketing communications (you can opt out at any time)

When a ticket is sold:
– Sellers receive: Runner’s full name, email address, and potentially date of birth and postal address (depending on race organiser transfer requirements)
– Buyers receive: Confirmation of transfer
Important for Sellers:
– You must use Buyer information solely for completing the ticket transfer
– You must not retain Buyer information after the transfer is complete
– You must not use Buyer data for marketing or any other purpose
– You must not share Buyer information with third parties (except the race organiser for transfer purposes)
– You must comply with UK GDPR when handling Buyer information
– Misuse of Buyer data may result in account termination and legal action
Information Shared:
The specific information shared depends on what the race organiser requires for their transfer process. This may include:
– Name (always required)
– Email address (always required)
– Date of birth (required by some race organisers)
– Postal address (required by some race organisers for bib delivery or registration)
We share information with trusted third-party service providers who process data on our behalf.
All service providers are contractually bound to:
– Process data only as instructed by Racee
– Implement appropriate security measures
– Comply with UK GDPR
We may share limited information with race organisers to:
– Verify ticket validity
– Confirm ticket transfers
– Resolve disputes
We may disclose your information if required by law or to:
– Comply with legal processes, court orders, or government requests
– Enforce our Terms and Conditions
– Protect our rights, property, or safety
– Prevent fraud or illegal activity
– Protect the rights and safety of our users
If Racee is acquired, merged, or sold, your personal information may be transferred to the new owner. You will be notified of any such change.
We retain your personal information for as long as necessary to provide our services and comply with legal obligations:
Active accounts:
– We retain your information while your account is active
Closed accounts:
– Account data is deleted 30 days after closure, except where we have a legal obligation to retain it
Transaction records:
– Financial and transaction records are retained for 7 years to comply with tax and accounting regulations
Dispute records:
– Information related to disputes is retained for 6 years from resolution (UK limitation period)
Marketing data:
– If you opt out of marketing, we retain a suppression record to ensure we don’t contact you again
We implement appropriate technical and organisational measures to protect your personal information:

Note:
– You cannot opt out of service-related communications (e.g., transaction confirmations, account notifications)
– Opting out of marketing does not affect other processing activities
Racee is not for users under 18 years old.
– We do not knowingly collect information from children under 18
– If we discover we have collected information from a child, we will delete it immediately
– If you believe we have information about a child, please contact us
Our Platform may contain links to third-party websites, race organiser sites, or social media platforms.
Important:
– We are not responsible for the privacy practices of third parties
– Third-party sites have their own privacy policies

Welcome to Racee (“we”, “us”, or “our”). Racee operates an online marketplace that allows users to list, sell, and purchase tickets for running races and similar sporting events.
By accessing or using Racee’s website, applications, or related services (the “Platform“), you agree to be bound by these Terms and Conditions (the “Terms“). If you do not agree, you must not use the Platform.
Racee acts solely as an intermediary marketplace. Tickets are sold by independent Sellers directly to Buyers. Racee is not the event organiser and does not issue tickets.
The Platform is available to UK residents only. For users accessing from Scotland or Northern Ireland, local consumer protection laws apply in addition to these Terms
* “Event” – a specific in-person race held on a fixed date, time, and distance. Virtual or hybrid races are not supported on the Platform.
* “Buyer” – a user purchasing a ticket through Racee.
* “Seller” – a user listing tickets for sale through Racee.
* “Ticket” – a valid physical or electronic proof of entry to an Event.
* “Platform” – the Racee website, apps, and related services.
* “Contract” – a contract for the sale of a Ticket formed directly between a Buyer and Seller through the Platform.
* You must be at least 18 years old to use Racee.
* You must be a UK resident to use the Platform.
* You shall provide accurate, current, and complete information when creating an account.
* You are responsible for all activity carried out under your account.
* Accounts are personal and non-transferable.
* You must provide accurate date of birth information for age verification purposes.
* Providing false information may result in immediate account termination.
* Racee may suspend or terminate accounts that breach these Terms or applicable law.
Payment Card Storage and Authorisation:
* By providing payment card details, you authorise Racee to:
– Store your card details securely for future transactions
– Process payments for purchases you make on the Platform
– (For Sellers) Charge your stored card for costs arising from breaches of these Terms, including but not limited to replacement ticket costs, refunds where your account balance is insufficient, and penalties for fraudulent or negligent conduct
* You may update or remove your stored payment card details at any time through your account settings.
* You must maintain valid and current payment card details. Cards that expire or are cancelled must be updated promptly.
* Racee provides a platform that connects Buyers and Sellers.
* The Contract for the sale of a Ticket is formed directly between the Buyer and the Seller, not with Racee.
* Sellers may be private individuals or businesses. Seller status may affect a Buyer’s statutory rights.
* Racee does not guarantee that tickets will sell or that Buyers or Sellers will complete a transaction.
* Racee is not liable for the actions, omissions, or breaches of Buyers or Sellers, except as expressly set out in the Racee Buyer Guarantee (Section 11).
Pricing Policy:
* Sellers shall list tickets up to the maximum of the original price paid to the race organiser.
* Transfer fees charged by race organisers are the Seller’s responsibility to absorb – Sellers may NOT add race organiser transfer fees to the listing price.
* Minimum listing price is £5.00.
* Race entries with a face value below £5.00 cannot be listed on Racee.
* Buyer fees are added on top of the seller’s listing price automatically at checkout.
* Racee reserves the right to remove listings that exceed documented face value or fall below the minimum price.
Sellers must:
* Own or have the legal right to sell the listed Ticket.
* Ensure Tickets are genuine, valid, and transferable.
* Comply with all applicable laws and event organiser rules.
* Accurately describe the Ticket, including race details.
* Maintain current and valid payment details at all times.
Listing Requirements:
* Listings constitute a binding offer to sell.
* Once a Ticket is sold, the Seller is legally obliged to deliver it as described.
* Sellers must confirm via checkbox that tickets are not championship entries or charity-affiliated places.
* Listing championship or charity-affiliated tickets constitutes a material breach and may result in account termination, refund obligations, and/or replacement ticket costs charged to the Seller.
Sellers may not:
* List tickets they do not control.
* Cancel a completed sale to re-list at a higher price.
* Provide substitute or downgraded tickets.
* List tickets for events that prohibit resale or transfer.
Seller Withdrawal Rights:
* Sellers may withdraw a listing before it sells.
* Once sold, the Contract is binding and cannot be cancelled except in exceptional circumstances approved by Racee.
* Cancelling a confirmed sale may result in account suspension, withheld payments, and/or liability for replacement costs
* Sellers will be notified when a Ticket sells and provided with Buyer details to enable entry transfer.
* Buyer information provided to Sellers may include: name, email address, date of birth, and postal address, depending on the race organiser’s transfer requirements.
* Sellers must use Buyer information solely for completing the ticket transfer and must not retain, share, or use it for any other purpose.
* Sellers must confirm ticket transfer initiation and provide proof within 72 hours of sale confirmation. Failure to do so may result in Racee sourcing a replacement ticket at the Seller’s expense, account suspension, payment withholding, and/or charges to the Seller’s stored payment card.
* Tickets must be delivered within the stated deadline.
* Buyers may need to accept tickets using the email provided at checkout depending on the race organisers process.
* Buyers must provide accurate information required for ticket transfers, which may include date of birth and address depending on race organiser requirements.
* The Seller initiates the transfer with the race organiser using the details provided by Racee.
Transfer Fees:
* Any transfer fees charged by event organisers are the Seller’s responsibility and must be absorbed by the Seller.
* Sellers cannot add transfer fees to the listing price or charge buyers separately.
Non-Transferable Tickets:
* Tickets for events that do not allow name transfers will not be accepted for listing on Racee.
* If an event organiser changes their transfer policy after a sale, making the ticket non-transferable, Racee will provide a full refund to the Buyer.
Transfer Confirmation:
* Ticket transfers will be confirmed by race organisers.
* Some bib numbers will be delivered before the event; others may be collected in the days before or on event day.
Failure to deliver valid tickets may result in refunds, withheld payments, penalties, charges to stored payment cards, and/or account termination.
Note: In some cases, tickets may only be transferred once, as set by event organisers. Tickets which can be resold may be re-listed on our website, but participants must check the event’s terms and conditions. Championship tickets are never accepted to be sold by race organisers and are not to be listed on Racee.
* Buyers must review listings carefully before purchase.
* Buyers must provide accurate contact and payment details.
* Buyers must provide accurate information required for ticket transfers, which may include date of birth and postal address, depending on the race organiser’s requirements.
* Buyers must report issues in accordance with Section 12.
* Buyers are responsible for meeting all event entry requirements, including age, qualification times, or other eligibility criteria stated in the listing. Failure to meet stated requirements does not entitle the Buyer to a refund.
* Buyers warrant they meet all age requirements for their purchased Event. Racee does not verify age eligibility for specific races. For the majority of races, this is a minimum of 16 years of age on the day of the event for 1km to half marathons, and 18+ for distances of a marathon and over.
* Buyers cannot cancel purchases. If a Buyer changes their mind, they may re-list the ticket on the Platform, subject to the event organiser’s terms and conditions regarding transfers.
All payments are processed through secure third-party payment providers.
Fee Structure:
* Buyers pay: 8% service fee + 2% payment processing fee (minimum total fee: £1.50) – these fees are added on top of the seller’s listing price at checkout.
* Sellers pay: 5% service fee (minimum fee: £1.50 per transaction) – this fee is deducted from the listing price when calculating your payout.
* No listing fees apply.
* All fees are displayed clearly before checkout completion.
Escrow and Payment Release:
* Buyer payments are held in escrow in safeguarded, FCA-regulated accounts.
* Seller payments are released 3 working days after the 48-hour dispute window closes (typically 5-6 days after the Event), provided no valid dispute has been raised.
* Racee reserves the right to hold payments where fraud is suspected or for high-risk transactions.
Tax Implications:
* Users are responsible for declaring income and paying taxes in accordance with UK tax laws.
* Racee does not provide tax advice or withhold taxes on behalf of users.
Refunds:
* Racee may withhold, reverse, or recover Seller payments (from escrow or account balance) where a Seller breaches these Terms.
Clawback Rights and Chargeback Handling:
* Racee retains the right to claw back payments from Sellers found to have provided invalid, fraudulent, or misdescribed tickets.
* This includes recovery through deduction from account balances, charges to stored payment cards, and/or legal means if necessary.
* If a Seller’s account balance is insufficient to cover refunds or replacement ticket costs, Racee will refund the Buyer from escrowed funds and pursue recovery from the Seller.
* Chargebacks: The fee, along with the chargeback amount, will be deducted from the Seller’s account balance. If the Seller’s balance is insufficient, Racee will attempt to charge the Seller’s stored payment card.
* Negative Seller Balances: If a Seller’s account balance becomes negative due to chargebacks, refunds, or other deductions, future transaction proceeds will be used to clear the negative balance before any payouts are made. Sellers with persistent negative balances may have their accounts suspended and/or terminated.
Seller Liability and Card Charges:
* By registering a payment card, Sellers authorise Racee to charge the registered card for:
– Costs incurred from sourcing replacement tickets due to Seller breach or failure to deliver
– Refunds owed to Buyers where the Seller’s account balance is insufficient
– Penalties for fraudulent listings or material breaches of these Terms
– Administrative costs associated with resolving disputes caused by Seller breach
* Racee will provide itemised notice before charging a Seller’s card, except in cases of fraud or urgent replacement ticket sourcing.
* Charges will be limited to actual costs incurred plus reasonable administrative fees.
Failed Card Charges:
* If a charge to a Seller’s stored card is declined or fails:
– Racee will notify the Seller via email with 48 hours to provide alternative payment
– The Seller’s account will be suspended until payment is received
– Failure to pay within 7 days may result in account termination and legal action
– Racee may report unpaid debts to credit reference agencies
Tickets sold on Racee are for specific dates and times and are therefore exempt from the 14-day cancellation right under the Consumer Contracts Regulations 2013.
This does not affect a Buyer’s statutory rights where tickets are invalid, misdescribed, or not delivered.
Racee is not the event organiser and does not control organiser refund policies.
If an Event is cancelled:
* Buyers will be provided with information on how to seek a refund from the organiser or original ticket issuer.
* Racee may assist administratively and manage escrowed funds where applicable and legally required.
* Responsibility for refunds in the event of cancellation lies with the event organiser and the person who holds the valid ticket registration.
Force Majeure:
Racee shall not be liable for any failure to perform or delay in performing any of its obligations under these Terms if such failure or delay is caused by circumstances beyond Racee’s reasonable control, including but not limited to:
* Acts of God, fire, flood, earthquake, or other natural disasters
* War, terrorism, civil unrest, or riots
* Strikes, lockouts, or labour disputes
* Failure of public or private telecommunications networks
* Failure of third-party service providers (including payment processors, hosting providers, or race organisers)
* Government action, legislation, or regulation
Neither party shall be liable for any loss or damage resulting from such force majeure events.
The Racee Buyer Guarantee applies to all purchases and operates in addition to statutory consumer rights.
Under this Guarantee:
* Tickets will be delivered on time.
* Tickets will be valid for entry.
* Tickets will match their description.
If a Seller fails to meet these obligations, Racee will refund the Buyer in full, including all service fees, subject to the reporting requirements in Section 12.
Scope of Guarantee:
* The Guarantee covers invalid tickets, non-delivery, and material misdescription.
* Different bib numbers than expected do not constitute grounds for refund unless the ticket is otherwise invalid.
* Only full refunds are provided under this Guarantee; partial refunds are not available.
* If Racee refunds a Buyer under this Guarantee, the refund will be processed from escrowed funds or by clawing back payment from the Seller’s account balance or stored payment card.
* Buyers must report ticket issues within 48 hours after the Event.
* The 48-hour dispute window begins immediately upon the Event start time and closes at 23:59 two days later.
* This reporting period assists investigation and does not limit statutory consumer rights.
* Racee may request reasonable evidence to assess disputes.
If tickets are invalid or not delivered:
* Buyers will receive a full refund, including all service fees.
* Seller payments will not be released from escrow, or will be deducted from the Seller’s account balance or stored payment card if already released.
Racee reserves the right to deduct refund amounts from a Seller’s account balance or charge the Seller’s stored payment card, even after funds have been released from escrow, if a valid dispute is raised within the reporting period or if fraud is discovered.
Failure to Report:
If buyers fail to notify Racee of any claim within the 48hour period after the event, Racee shall have no liability to the buyer under the buyer guarantee, without prejudice to your statutory consumer rights.
When a Buyer reports an issue:
* Racee will request evidence from both the Buyer and Seller within 3 working days of the dispute being raised.
* Both parties must provide requested evidence within 48 hours of Racee’s request.
* Evidence may include: ticket confirmation emails, transfer confirmations, race organiser correspondence, screenshots, or photographic proof.
* Racee will make a final determination within 5 working days of receiving all evidence from both parties.
* If a Seller disputes a Buyer’s claim, Racee will act as an intermediary and evaluate evidence from both sides.
* Racee’s decision is final and binding, without prejudice to statutory consumer rights or the parties’ rights to pursue legal action.
* Racee acts in good faith to resolve disputes fairly based on the evidence provided.
Users may not:
* List fake, stolen, or invalid tickets.
* Circumvent Racee’s payment or delivery systems.
* Arrange or complete transactions outside the Racee platform to avoid fees.
* Misuse accounts or personal data.
* Engage in fraud or abuse of the Buyer Guarantee.
* Interfere with the operation of the Platform.
* List tickets for events that prohibit resale or transfer.
* Provide false information about ticket restrictions, wave times, or entry requirements.
* Create multiple accounts to circumvent restrictions or bans.
* Initiate chargebacks or payment disputes for legitimate transactions.
* Provide invalid or expired payment card details.
* Use payment cards without authorisation from the cardholder.
Platform Content:
* All Platform content, including but not limited to text, graphics, logos, images, software, and compilations, is owned by Racee or its licensors and is protected by UK and international copyright, trademark, and other intellectual property laws.
* Users may not copy, reproduce, distribute, modify, or exploit Platform content without Racee’s express written permission.
User Content:
* Users grant Racee a worldwide, non-exclusive, royalty-free licence to use, reproduce, display, and distribute content submitted to the Platform (including listings, reviews, and communications) for Platform operations, marketing, and improvement purposes.
* Users warrant that they own or have the right to submit such content and that it does not infringe third-party intellectual property rights.
Personal data is processed in accordance with Racee’s Privacy Policy and applicable UK data protection laws, including UK GDPR.
Data Sharing:
* Sellers will receive the Buyer’s name, email address, and potentially date of birth and postal address (depending on race organiser transfer requirements).
* Sellers must use Buyer information solely for completing the ticket transfer.
* Sellers must not retain Buyer information after the transfer is complete.
* Sellers must not use Buyer data for marketing or any other purposes.
* Sellers must not share Buyer information with third parties (except the race organiser for transfer purposes).
* Sellers must comply with UK GDPR when handling Buyer information.
* Misuse of Buyer data may result in account termination and legal action.
Information Shared:
The specific information shared depends on what the race organiser requires for their transfer process. This may include:
* Name (always required)
* Email address (always required)
* Date of birth (required by some race organisers)
* Postal address (required by some race organisers for bib delivery or registration)
Data Security:
* Data will be secured by Racee and only essential data will be shared with Sellers as necessary to complete ticket transfers.
* All payment card details are stored and processed securely by Racee’s PCI-DSS compliant payment provider (Ryft).
Racee is not responsible for:
* Event cancellations or changes.
* Organiser or venue decisions.
* Non-admission due to late arrival, failure to meet entry requirements, or other factors outside Racee’s control.
* Event-related issues that are the responsibility of race organisers.
Statutory Protections:
Nothing in these Terms excludes or limits liability for:
* Fraud or fraudulent misrepresentation.
* Any liability that cannot be excluded under UK law.
General Limitation:
Subject to the above, Racee’s total liability to any user for any loss or damage arising out of or in connection with these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the service fees paid by that user for the affected transaction.
Racee shall not be liable for:
* Loss of profits, revenue, or business.
* Loss of anticipated savings.
* Loss of business opportunity.
* Loss of goodwill or reputation.
* Any indirect or consequential loss or damage.
Users agree to indemnify and hold harmless Racee, its affiliates, directors, officers, employees, and agents against all losses, damages, liabilities, claims, costs, and expenses (including reasonable legal fees) arising from:
* Breach of these Terms.
* Invalid or unlawful ticket listings.
* Violation of laws or third-party rights.
* Provision of false or misleading information.
* Misuse of Buyer personal data (for Sellers).
* Any claim made by a third party arising from your use of the Platform.
Seller Financial Responsibility:
* Sellers remain financially responsible for all costs arising from breaches of these Terms, including but not limited to:
– Replacement ticket costs if the Seller fails to deliver or provides invalid tickets
– Buyer refunds where the Seller’s account balance is insufficient
– Administrative and legal costs incurred by Racee in resolving disputes caused by Seller breach
– Any penalties or damages resulting from fraudulent or negligent conduct
* Racee will first deduct amounts owed from the Seller’s account balance (including funds in escrow or already released).
* If the account balance is insufficient to cover amounts owed, Racee reserves the right to:
– Charge the Seller’s stored payment card
– Pursue recovery through debt collection procedures
– Report unpaid debts to credit reference agencies
– Initiate legal proceedings to recover amounts owed plus interest at 5% above the Bank of England base rate
– Withhold future payments until debts are settled
* The Seller will be liable for all reasonable costs of recovery, including legal fees and court costs.
* This financial responsibility survives account closure or termination.
By Racee:
Racee may suspend or terminate accounts immediately by written notice if:
* You commit a material breach of these Terms and, in the case of such a breach which is capable of remedy, you fail to remedy the same within 7 days of receipt of written notice specifying the breach and requiring it to be remedied.
* You engage in fraudulent activity or abuse of the Platform.
* You make any voluntary arrangement with your creditors or (being an individual or firm) become bankrupt or (being a company) become subject to an administration order or go into liquidation, or an encumbrancer takes possession or a receiver is appointed over any of your property or assets, or you cease or threaten to cease business.
* You create multiple accounts or attempt to circumvent Platform restrictions.
Effect of Termination:
* Upon termination, any outstanding disputes will be resolved in accordance with Section 12A.
* Any remaining account balance will be handled in accordance with Section 8.
* Terminated users may not create new accounts without Racee’s express written permission.
* Any termination shall not prejudice any rights or remedies which may have accrued to either party.
These Terms are governed by the laws of England and Wales.
For users in Scotland, the laws of Scotland apply. For users in Northern Ireland, the laws of Northern Ireland apply.
The courts of England and Wales have exclusive jurisdiction for users in England and Wales. Users in Scotland and Northern Ireland are subject to the jurisdiction of their respective local courts.
Changes to Deadlines:
* Racee will use reasonable endeavours to meet the deadlines and timelines set out in these Terms.
* Racee reserves the right to modify timescales where unavoidable due to technical issues, payment processor delays, or other circumstances beyond Racee’s reasonable control.
* Time alone shall not be of the essence except where expressly stated in these Terms (e.g., 48-hour reporting window, 72-hour transfer deadline).
Changes to Terms:
* Racee reserves the right to modify these Terms at any time.
* Users will be notified of material changes via email or prominent notice on the Platform.
* Continued use of the Platform after changes constitutes acceptance of the modified Terms.
* If you do not agree to the modified Terms, you must stop using the Platform.
Severability:
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Waiver:
No failure or delay by Racee in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. No single or partial exercise of any right or remedy shall preclude further exercise of that right or any other right or remedy.
Assignment:
You may not assign, transfer, or delegate your rights or obligations under these Terms without Racee’s prior written consent. Racee may assign its rights and obligations under these Terms without restriction.
Third-Party Rights:
Nothing in these Terms confers or purports to confer on any third party any benefit or the right to enforce any term of these Terms pursuant to the Contracts (Rights of Third Parties) Act 1999.
Entire Agreement:
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Racee with respect to the subject matter hereof and supersede all prior or contemporaneous oral or written understandings, agreements, or representations. Terms and conditions on any user order or communication are expressly rejected and shall have no effect.
